In March 2024, the Ministry of Corporate Affairs released the Report of the Committee on Digital Competition Law, which aims to regulate anti-competitive practices in digital markets and promote fair competition to protect the interests of consumers. Highlighting the growing concentration of digital markets with a few large digital enterprises creating imbalances in bargaining power and information asymmetry for smaller enterprises and start-ups, emphasis is also made on the need for an ex-ante digital competition law to ensure that MSMEs and startups are not burdened with additional compliance obligations and that their opportunities and incentives for innovation are not hindered.
India SME Forum is organising a Webinar on "Impact of the Draft Digital Competition Law on MSMEs" as part of its online show "Enterprise Matters" to deliberate and explore the potential implications of the draft Digital Competition Law on Micro, Small, and Medium Enterprises (MSMEs). Discussions will also include an overview of key provisions in the draft law and their implications for MSMEs, the impact of ex-ante regulations on MSMEs and the need for a balanced approach, the role of the new law in preventing monopolistic behaviour and promoting fair competition, challenges and opportunities for MSMEs in the digital economy & various strategies for MSMEs to adapt and thrive in a changing regulatory environment.
